US initiates anti-dumping investigations on fibres from Korea, Taiwan

US secretary of commerce Wilbur Ross has announced the initiation of new antidumping duty (AD) investigations to determine whether imports of low melt polyester staple fibre (PSF) from Korea and Taiwan are being unfairly dumped in the US. These AD investigations are based on petitions filed by Nan Ya Plastics Corporation, America on June 27, 2017.

The investigations are expected to determine whether imports of low melt PSF from Korea and Taiwan are being dumped in the US market at less than fair value. The estimated dumping margins alleged by the petitioner for Korea and Taiwan are 39.24 to 52.23 per cent and 28.47 to 73.21 per cent, respectively.

If the commerce department determines that low melt PSF from Korea and Taiwan are being dumped into the US market, and if the US International Trade Commission (ITC) determines that dumped US imports of low melt PSF from Korea and Taiwan are causing injury to the US industry, the commerce department will impose duties on those imports in the amount of dumping found to exist, said the International Trade Administration in a press release.

In 2016, imports of low melt PSF from Korea and Taiwan were valued at an estimated $76.6 million and $26.8 million, respectively.

During the commerce department investigations, the ITC will conduct its own investigations into whether the US industry and its workforce are being harmed by such imports. The ITC will make its preliminary determinations on or before August 11, 2017. If the ITC preliminarily determines that there is injury or threat of injury then the commerce department investigations will continue, with preliminary antidumping determinations scheduled for December 2017, unless these deadlines are extended.

If the commerce department preliminarily determines that dumping is occurring, then it will instruct US customs and border protection to start collecting cash deposits from all US companies importing the subject low melt PSF from Korea and Taiwan.

Final determinations by the commerce department in these cases are scheduled for February 2018, but may be extended. If either the commerce department does not find that products are being dumped or the ITC does not find in its final determinations there is harm to the US industry, then the investigations will be terminated and no duties will be applied.

From January 20, 2017, through July 18, 2017, commerce department has initiated 53 antidumping and countervailing duty investigations. Commerce currently maintains 404 antidumping and countervailing duty orders which provide relief to American companies and industries impacted by unfair trade.

Foreign companies that price their products in the US market below the cost of production or below prices in their home markets are subject to antidumping duties. Companies that receive unfair subsidies from their governments, such as grants, loans, equity infusions, tax breaks and production inputs, are subject to countervailing duties aimed at directly countering those subsidies.
